Outline for Sehat Wellness Marketing
This document establishes the contractual agreement for your online sales.
General Acceptance and Governing Law
- Acceptance: User agrees to be bound by these T&C upon browsing the site or placing an order.
- Governing Law: This agreement shall be governed by and construed in accordance with the laws of Malaysia.
- Business Details: Clearly state your registered business name (as registered with SSM), registration number, and address, as required by the Consumer Protection (Electronic Trade Transactions) Regulations 2012.
Product Information and Pricing
- Accuracy: State that while you strive for accuracy, product descriptions, images, and prices may contain errors.
- Pricing: Clearly state that all prices are in Ringgit Malaysia (RM) and whether they include or exclude the relevant Sales and Services Tax (SST) (if applicable).
- Order Cancellation: Reserve the right to refuse or cancel an order if the product is mispriced or unavailable, even after an order confirmation.
Orders, Payment, and Shipping
Order Confirmation
Explain that an order confirmation email is not acceptance of the order; it is a confirmation that you received the request. The sale is concluded upon shipment.
Payment Methods
Clearly list accepted payment methods (e.g., credit card, online bank transfer, e-wallets).
Shipping & Delivery
- State the estimated delivery times and that these are estimates only.
- Clearly outline shipping fees and any geographical restrictions.
- Define the point at which risk of loss/damage for the goods transfers to the customer (typically upon delivery).
Cancellation, Returns, and Refunds (Crucial under CPA)
Returns Policy
- Clearly detail your policy for returns and exchanges.
- Define the period (e.g., 7 or 14 days) within which a return request must be made.
- Specify the condition the product must be in (e.g., unworn, original packaging).
Defective/Misdescribed Goods
State the customer’s right to a refund, repair, or replacement for products that are defective or not as described, in line with the Consumer Protection Act 1999 (CPA).
Refunds:
Outline the refund process, including the form of refund (e.g., credit to original payment method) and the processing time.
Limitation of Liability and Warranties
- Disclaimer: State that the service and products are provided "as is" and "as available."
- Limitation: A clause to limit your maximum liability to the price paid for the product. (A lawyer must draft this section carefully to ensure compliance with the CPA.)
